Terms and Conditions
1 Contract Formation
1.1 Contractual parties are Illenauwiesen Parken+Service GmbH as the operator of blackforestsuites (hereinafter referred to as "blackforestsuites") and the guest. By making a reservation, the guest offers to conclude an accommodation contract. Upon availability of the requested unit, the guest receives a reservation confirmation from blackforestsuites. The accommodation contract is established upon acceptance of the reservation by blackforestsuites. blackforestsuites reserves the right to confirm the booking in text form. blackforestsuites may, at its sole discretion, refuse to conclude an accommodation contract.
1.2 If a third party makes the reservation on behalf of the guest, this third party is jointly and severally liable with the guest for all obligations under the accommodation contract, provided that blackforestsuites has received a corresponding declaration from the third party. The third party is subject to these terms and conditions.
1.3 The minimum age for making a booking is 18 years. Minors are not allowed to stay in a unit without a legal guardian who is of legal age.
2 Reservations
2.1 By submitting a reservation request and its acceptance by blackforestsuites, the guest does not acquire the right to a specific unit unless explicitly agreed in writing as part of the accommodation contract.
2.2 Offers by blackforestsuites regarding available units are non-binding and subject to change.
2.3 Guests have no entitlement to accommodation in a specific unit. blackforestsuites reserves the right to impose standard industry restrictions, such as minimum stays, booking guarantees, or advance payments for certain booking dates.
3 Cancellation Periods
3.1 A guaranteed reservation can be canceled free of charge by the guest according to the cancellation policies provided by blackforestsuites, using the reservation number unless a non-cancellable booking was selected. A reservation is considered guaranteed once payment has been received by blackforestsuites. Cancellation in this context means the room is no longer reserved for the guest, and the guest is entitled to a refund of the paid amount. If the guest fails to cancel by the agreed deadline, as stated in the booking confirmation, no refund will be issued.
3.2 After the expiration of the cancellation periods, the guest is not entitled to a refund. blackforestsuites retains the agreed remuneration, less any savings in expenditure.
3.3 blackforestsuites also retains the agreed remuneration in cases of no-shows or early departures. In the event of a no-show for a multi-day reservation, blackforestsuites reserves the right to release the unit for subsequent nights starting from the second night.
3.4 If the guest has already checked into the unit on the day of arrival, the right to cancel free of charge is forfeited upon check-in. Subsequent cancellations do not entitle the guest to a refund.
3.5 For bookings made through third-party providers rather than directly via the blackforestsuites website, cancellations must comply with the terms agreed upon between the guest and the provider. Refunds, if applicable, will also be processed by the third-party provider, not by blackforestsuites.
4 Accommodation Prices and Other Fees
4.1 The prices at the time of contract conclusion, as stated by blackforestsuites, apply. These prices are gross total amounts, including all applicable taxes, fees, and charges, except for local fees (e.g., city tax), which may be payable by the guest based on local law.
4.2 In the event of changes to tax rates, fees, or charges, or the introduction of new fees previously unknown at the time of contract conclusion, blackforestsuites reserves the right to adjust prices accordingly. For consumer contracts, this only applies if the period between the booking confirmation and the adjustment exceeds four months.
4.3 blackforestsuites may condition its agreement to a subsequent reduction in the number of booked units, services, or duration of stay on an increase in the daily rate due to the shorter rental period or reduced rental volume.
5 Payment Terms
5.1 The total price for the booked accommodation service must be paid in advance. If the guest is not the same as the person making the booking, the payment terms outlined here also apply to the booking party.
5.2 Set-off by the guest is excluded unless it concerns an undisputed or legally established claim.
5.3 Accepted payment methods include Mastercard, Visa, American Express, PayPal, Apple Pay, and Google Pay. Bank transfers are only available upon request for corporate customers. Cash payments are not accepted.
5.4 For additional charges arising from services used or breaches of the general terms and conditions, blackforestsuites reserves the right to charge the payment method provided.
5.5 Invoices without a due date are Parabel immediately upon receipt without deductions. For late payments, blackforestsuites is entitled to charge statutory default interest.
6 Use of Reserved Units
6.1 Reserved units are available to the guest from 3:00 PM on the day of arrival until 11:00 AM on the day of departure. The guest has no entitlement to earlier or extended use of the unit.
6.2 Unless otherwise agreed, any keys or code cards provided must be returned to blackforestsuites or an authorized representative upon departure. If keys or cards are lost or not returned, a fee of €40.00 gross will be charged. blackforestsuites reserves the right to claim additional damages if the actual costs exceed €40.00, including the costs of replacing the lock system if required for security reasons.
6.3 A later departure ("Late Check-out") may be arranged upon request and subject to availability. blackforestsuites reserves the right to charge €10.00 per hour started for extended use of the unit. Departures after 2:00 PM will incur the full current daily rate. There is no contractual right to a Late Check-out.
6.4 If the guest fails to vacate the unit by 11:00 AM, blackforestsuites may charge 50% of the full daily rate for use until 2:00 PM and 100% thereafter.
6.5 An earlier arrival ("Early Check-In") may be arranged upon request and subject to availability. blackforestsuites reserves the right to charge €10.00 per hour started. There is no contractual right to an Early Check-In.
7 Resale or Subletting
7.1 The resale, subletting, or transfer of reserved units to third parties is strictly prohibited. Particularly, units or quotas must not be resold or reallocated at higher prices. Assignment or sale of claims against blackforestsuites is also prohibited. In such cases, blackforestsuites reserves the right to cancel the booking without refund.
7.2 Subletting units, use for non-accommodation purposes, or utilizing spaces outside the rented premises for promotional events, interviews, sales, or similar activities require prior written consent from blackforestsuites. Section 540 (1), Sentence 2 BGB does not apply if the customer is not a consumer.
7.3 Using the unit for purposes other than accommodation, particularly for business activities, is strictly prohibited. Violations may result in immediate termination of the contract, with the guest liable for damages.
8 Liability of blackforestsuites
8.1 blackforestsuites is liable for damages to life, body, or health caused by its negligence. Liability for other damages is limited to foreseeable, typical damages arising from a breach of cardinal obligations. blackforestsuites is not liable for minor negligence unless it pertains to essential contractual duties.
8.2 blackforestsuites will address disturbances or deficiencies in its services upon notification. Guests are obliged to mitigate damages where possible and notify blackforestsuites promptly of potential claims.
8.3 Liability for guest property follows statutory provisions. For valuable items exceeding €800 or other items exceeding €2,500, liability is limited unless stored securely (e.g., in a room safe).
8.4 No custody contract arises when parking spaces are provided. blackforestsuites is not liable for theft or damage to vehicles unless caused by gross negligence.
8.5 Claims against blackforestsuites generally expire one year after the statutory limitation period begins, except for damages involving life, body, or health or due to gross negligence.
8.6 blackforestsuites assumes no liability for lost property unless due to gross negligence. Found items are stored for six months and can be returned for a fee.
9 Guest Data and Digital Check-in
9.1 To ensure communication, blackforestsuites requires guests to provide an email address and phone number. Identification documents and credit card details may also be required for digital check-in.
9.2 If guest identity cannot be verified due to missing or incorrect documentation, blackforestsuites may cancel the reservation and deny access.
9.3 Anti-fraud measures may be employed to detect fraudulent bookings. Suspicious reservations may be canceled.
9.4 Only listed guests are allowed to enter the unit during the booking period. Unregistered visitors may result in eviction or additional charges.
10 Termination of Accommodation Contract
10.1 blackforestsuites may terminate the contract for good cause, including force majeure, illegal activities, or violations of these terms.
10.2 If termination is due to the guest's actions, blackforestsuites may also cancel or refuse future bookings.
11 Non-Smoking Policy
11.1 All units are non-smoking. Violations incur a penalty of €150.00 and potential cleaning costs or revenue loss due to unavailability for rental.
11.2 Fire alarms triggered by smoking result in full liability for costs incurred.
12 Quiet Hours and Prohibition of Parties
12.1 Quiet hours are from 10:00 PM to 8:00 AM. Loud events or parties are prohibited.
12.2 Violations result in a €250.00 penalty and may lead to termination of the accommodation contract.

13 Damage or Theft
13.1 Guests must handle the unit with care and report any damage. Significant cleaning fees of at least €50.00 may be charged for excessive dirt.
13.2 Damages or theft caused by the guest or their visitors may result in compensation claims.
14 Pets
14.1 Pets are not allowed, except for service animals. Unauthorized pets incur a fee of €150.00 and additional cleaning or revenue loss claims.

15 Maintenance
15.1 Guests must handle the unit and its furnishings with care and allow access for scheduled maintenance or cleaning. Refusal may result in additional fees.

16 Group Bookings and Event Periods
16.1 Special terms apply for group bookings (more than five units) or during event periods.
17 Internet Use
17.1 Internet is provided subject to technical and operational availability. Misuse, including illegal streaming or data sharing, is prohibited.
17.2 Guests are liable for damages caused by misuse or sharing of internet access credentials.
18 Data Protection
18.1 The data protection policy of blackforestsuites can be found at https://www.blackforestsuites.de/datenschutz.
19 Final Provisions
19.1 blackforestsuites reserves the right to amend these terms and conditions. German law applies exclusively.
